Back to HB after a fantastic trip to Yosemite to speak about my new book, and ALSO, more importantly, celebrate my 25th wedding anniversary with my wife, Jean.  I’ll be all over the country this year, talking about my book in this centennial year of the National Park Service. But before getting back to writing some HB stories, thought I’d share some images from the trip….

When Union Reps Attack – a follow up to yesterday’s OVSD story

Yesterday I posted a story about information received by several OVSD employees regarding new information behind why I was disinvited to speak at one of their elementary schools as part of an author’s program. As I explained, I have a 16-year career of speaking at many local schools, was chosen by Circle View this year as a result of how popular my talk was there last year, but then was mysteriously dropped.

I thought little of it, until I heard from several people in the district several days ago that something more calculated and organized had in fact taken place- that a call from the district superintendent set off a chain of events and excuses resulting in my banishment.

In a much discussed OVSD Facebook forum last night, more than 12 hours after the topic was posted, a school representative finally answered back – right in the public forum. A quick search revealed that she is not just a teacher at the school – but also the school site rep for the powerful teacher’s union – which she did not even mention.

In addition to what some seemed to perceive an an aggressive hostility, the union rep/teacher shared her version of what transpired.

Within moments of posting she blocked me so I could no longer follow her attacks.

In my opinion,  there were several key contradictions as presented by her. First, she claimed that she was part of a selection committee, then seemed to take full credit for choosing me, adding that she’d never heard of me. That’s fine, but it doesn’t explain what followed, mainly, several comments that clearly seem to suggest that for reasons unstated in any official communication between the school and the event organizers, than I am no longer welcome in the district:

“Sometimes there are consequences to your actions. And I would say it seems like this might be yours.”

“Maybe you have never heard the idiom, don’t bite the hand that feeds.”

“There are many other districts out there and I would encourage you to venture your horizons in other directions.”

“It is obvious that your actions on this forum have put a nail in your own coffin. I just hope you realize that there are hundreds of teachers and parents on this forum who have now seen you for who you are. And next year when Author’s day comes around I won’t be surprised if your name doesn’t get chosen again.* It is not a ban. Yet freedom of choice. And a good one at that.”

This from a teacher/union rep that chose me, claiming not to know a thing about me- and then using the fact that I spoke at the school last year as an excuse. (For the record, again, I’ve also been told by someone else that I was chosen BECAUSE of how I performed last year.)

I think if you read her words closely, it becomes very clear what is going on here. Which Is why I’ve contacted the superintendent to inquire about public behavior like this from a teacher/union rep. I also asked the superintendent about the communication from her office to the school in regards to me.

I received many supportive, private messages this morning and they all included the same observation: Why is the union rep the one to get involved and attack you like this? What is the motive and agenda?

PS – this arrived a moment ago from someone: “I read the post from the lady at Circle View. I was at author selection day and that school was happy to have you back- they knew they had you the year before that is why they picked you. I just wanted you to know this.”

(HUNTINGTON BEACH, CA) Jan. 25, 2016 – The Southern California skies will be rocked like never before as the inaugural Surf City USA Airshow announces not one but two headlining jet teams. The United States Air Force Flight Demonstration Squadron – the Thunderbirds, and the Breitling Jet Team are scheduled to headline this premier event slated for October 22-23 over the Pacific Ocean in Huntington Beach – Surf City, USA.

 

The inaugural Surf City Airshow will be the only beachfront airshow on the West Coast, and the first airshow held in Huntington Beach, California in over twenty years.

The OVSD appears to have banned an author- ME.

Some background: for the last 16 years, I have taken part in the annual Author’s Day   event put on by the Friends of the Children’s Library. In that time, I’ve spoken to literally thousands of students in the district, donated hundreds of books, created writing programs, and helped mentor young writers in addition to other efforts. I think it’s the single most rewarding thing I’ve had the privilege of being part of in this community.

Authors are chosen each fall in a lottery system. This past year, I learned that Circle View elementary, who had the first pick of authors, chose me. I was flattered. They chose me last year too and evidently felt good enough about the experience to invite me back. This has happened more than once. Some schools have invited me back three and four times, to enthusiastic reviews.

But then something mysterious happened. A week or two later I discovered that the principal of Circle View had written the event organizers a letter to say that they didn’t want me to speak anymore. They said that some teachers felt that because I had been there last year, that it wasn’t a good idea to have me back. This was strange. When they chose me, they knew I had been there last year. So why the change? In the back of my mind, I wondered if this was a continued part of the OVSD attack on me personally. But then I thought, there’s no way that even they would sink to such a level as this. Well, it seems I was wrong.

Last week, I received a private message from someone I don’t even know who works in the district. They were writing to say how disappointed they were that I would not be speaking at the school and how badly they felt that I had been “banned” by the district.

I was stunned. “Banned?” I reached out to the person and we had a conversation. I received details about a call from the superintendent’s office which, in no uncertain terms, stated that I was no longer allowed to speak at the school. As well, according to this person, the school was told that If I was to call, no one was to even talk to me.

This made me sick. Why would the OVSD superintendent get involved with Author’s Day?

Fortunately, the Hebrew Academy extended an invitation to me and we spent a wonderful day yesterday. But then, at the authors reception held at Central Library in the afternoon, I was approached by another person I have never met before. They introduced themselves, then also expressed dismay, disappointment and anger over the fact that I had been banned, evidently, throughout the OVSD system. “First, the OVSD tried to ban a book. And now they’ve banned an author,” they said. “You.” As to the excuse made about me speaking last year, this person said I was chosen specifically BECAUSE of how much they enjoyed my presentation last year, exposing what now appeared to be an outright lie.  “Many of us are very upset about this,” they said. “We think it’s a disgrace. They are not being honest and they are punishing you for asking them questions they don’t like. This is all because of that.”

At the library, yet another source described a meeting last week where other educators who were aware of this banning expressed similar anger and disappointment at the fact that school officials could behave in such an irresponsible manner.

Understandably, everyone who spoke to me did so with an understanding that I would not reveal their identities. Because everyone that spoke to me expressed fear for their jobs for speaking their minds.

Of all the OVSD school officials have tried to do to me, I think this is the worst. This is my livelihood, my profession and most importantly, my passion. Speaking to young people about writing is something I truly value. For school officials to destroy that experience as as part of their vindictive and destructive campaign against me, in my opinion, is not just unethical, but an absolutely reckless dereliction of duty and abuse of power. Manipulating a celebrated local program to once again try to silence free expression? It is outrageous.

I am fairly confident that the school officials have created enough cover whereby they will be able to deny the calls that were made and support their excuses (or have some teachers lined up willing to back the excuse).  They know the people won’t speak up. And it’s part of that fear and intimidation campaign that they seem to be hanging their collective reputations on.

Thank you to those that were brave enough to reach out to me to reveal this scheme. We’ve never spoken or met before, yet you felt strongly enough about this to let me know what is really going on. I truly appreciate that and encourage any other staffers to contact me in strict confidence to report this kind of (in my opinion) abusive, reprehensible behavior (chris@chrisepting.com).

I think I see the strategy now: these school officials feel that by lying about me, saying things like Ms. Clayton-Tarvin (and her child!) was publicly “attacked” by me, that they can now punish me based on those made-up stories. Well, they’ve picked the wrong fight. They are not allowed to create an artificial reality for the sole purpose of punishing someone that dare tries to hold them accountable for their words and actions.

And their arrogance to think that they can get away with actions such as this, speaks volumes. This is out in the open now. Where it belongs.

And to all the librarians in the district, as always I will make myself available, on my own time and own dime, to help spread the word of writing to your students. Don’t be bullied by these (in my opinion) thugs. They are making a mockery of what it means to lead and set positive examples for children.

Together, we can make a difference. I promise you we can do this.

My New Column in the HB Local News

I’m pleased to announce my new column in the HB Local News. The’ve dubbed it “Epting’s World” and so that’s what it will be; my world in and around Huntington Beach. As the kickoff column states, I will continue to write about human interest stories in HB, along with investigating some harder hitting issues as stated in the piece. Audio Edition: OVSD Parent Tired of Waiting For Asbestos Answers From District

Since the 2014 asbestos controversy in the Ocean View School District in the fall of 2014, a number of Huntington Beach parents have remained concerned over what they perceive as non-responsiveness and in some cases, stonewalling from the current school board, led by President Gina Clayton-Tarvin, over follow-ups, resolutions and other information related to the incident(s).

One parent, Jim Sagara, this week re-posted a series of questions for the board on an OVSD Facebook forum page. They are included below. He had originally posted them back in ’14, was dissatisfied with the answers he received and decided to take another try at getting more direct, informative responses (as of this writing, the publicly-posted questions remain unanswered).

On the heels of at least one of the affected school finally re-opening, I spoke with Sagara this week about his mounting frustrations with the district (which resulted in him pulling his daughter of Mesa View to be home schooled). Here is our conversation:

This is a followup to the open letter I posted to Gina Clayton Tarvin and John Briscoe.
Ms. Clayton Tarvin and Mr. Briscoe,

It has been more than a year since I asked specific questions of you. In that time two board members were replaced with persons that you advocated for, and supposedly are sympathetic to your concerns. Also the Superintendent was replaced with a person of your choosing, as well as the assistant superintendent being let go.

1. Was the incident at Mesa View in which I described ever investigated? Specifically I refer to my account of September 2nd (the day before school started and before the clean up was finished) whereas myself, my daughter, and dozens of other people were exposed to clouds of dust from an active asbestos clean up site. There were no caution or warning signs. The campus was not closed. Nobody asked us to leave so they could blow dust everywhere. Why was dust being allowed to be blown all over from an asbestos clean up site? If this was investigated, who did the investigation? What were their findings? If there was no investigation, why not?

2. According to construction records, Mesa View was not cleared to reopen until the first day of school. Once again, I ask, was this before or after students and teachers arrived? If it was after people arrived, who in the district gave them permission to open before the clean up work had been inspected and approved?

3. Whom, if anyone has investigated Paul Moberly’s claims that asbestos was spewing everywhere as a Mesa View roof was being torn off, and specifically onto a ball field where children were playing. What agency investigated this? What were their findings? Was any effort made to identify the children? If not, why not?

4. Paul Moberly also claimed that he had reported violations to the district that were ignored. Is this true? If so, what district personnel were aware of violations, and were such violations handled appropriately?

5. Are there any pending lawsuits against OVSD concerning asbestos and/or construction related incidents? Who are the plaintiffs? In which court system are they filed? Please provide the case numbers if any.

6. Does OVSD currently have any pending litigation against the construction and oversight companies which were operating during the asbestos incidents? If so, please provide the court system and case number.

7. Was the incident at Hope View, in which a cloud of “construction dust” billowed through the school just minutes before students arrived ever investigated? What materials did this dust contain? If it was not investigated, why not? If the dust was not analyzed for toxins and carcinogens, why not? Has any new training been implemented to principals and support staff to keep a school closed until any future mysterious clouds have been thoroughly tested?

8. Has anyone within OVSD, working on behalf of OVSD, or any investigative entity looked at phone records, text messages, emails or any other forms of communications, to try and ascertain what OVSD personnel knew of violations and whether such violations were handled in an appropriate manner? What were their findings? If not, why not?

 I sincerely hope to get specific and concise answers, and not politically filtered legalese which doesn’t actually answer the direct questions. I really hate the idea of writing back and forth to faceless bureaucrats in Sacramento or file a Freedom of Information Act just to coerce real answers from a local school district that is a half mile from my home.

And these were the answers Sagara had originally received from Clayton-Tarvin in October 2014 – the responses that he felt were highly unsatisfactory. Be your own judge:

Gina Clayton-TarvinJim Sagara, This evening, I finally got the answers to your questions from the District. Please read and review. As a Trustee, I had nothing to do with the preparations of these answers, you should contact the District if you have any questions about these responses. Better yet, I would come to our Board Meeting on Tuesday night to address the Superintendent yourself. We will meet at 7:30pm for Open Session……
1. According to PUSH, Mesa View was not cleared by the AQMD until the first day of school. Was this before or after staff and students arrived?
All roofing material had been removed prior to September 3, 2014, and the associated transite from the main roofing operation had already been removed. Another asbestos contractor, ERSI, completed both the physical removal of transite that was found on the site as well as the clean-up involved in the removal for an exterior Procedure 5. The Procedure 5 work plan was filed for September 2, 2014, and work commenced the next day. Patriot Environmental’s closure report states the visual inspection occurred on September 3, 2014, and the report was filed with SCAQMD on September 6, 2014.

2. What oversight was there over the cleanup of the Mesa View violations? Was a third party observer or advisor there for the entire process? I would guess there are photos documenting the violations. Who has them and when can we see them?
The asbestos violation at Mesa View was caused by a contractor named B&M Tear Off, which is a licensed roofing contractor qualified to perform asbestos removal work. B&M Tear Off’s roof removal deviated from contractually required asbestos removal procedures and those that are typical in the industry. The DSA inspector, Paul Moberly, notified SCAQMD of the violation and a Procedure 5 was commenced soon after the violation on August 23, 2014. B&M Tear Off did not perform the Procedure 5, rather, ERSI, a licensed outside abatement contractor was brought in to undertake the Procedure 5 operation. This Procedure 5 was written and overseen by Patriot Environmental. Patriot Environmental was required to report on the completion of the Procedure 5 and filed its report with SCAQMD on September 6, 2014.

3. Who is Paul Moberly and was he fired from his position as inspector? Who fired him and why? I have an archived Facebook post in which he briefly tells of violations that his reports fell on deaf ears, and have also read a parent’s account of speaking to him. Were District officials asked to come to construction sites to observe violations? Did they show up and where is the documentation? Are there other violations that have been reported, that as of yet have not been made public? Why have no public statements from Mr. Moberly been forthcoming?
Paul Moberly was the DSA inspector for the Mesa View and Hope View projects. Mr. Moberly was hired to inspect project drawings and specifications. Typically the DSA project inspector is responsible to oversee all aspects of the construction project pursuant to the requirements of the DSA approved plans and specifications, except for certain areas that are contracted under the DSA inspector’s oversight called special inspection. Asbestos operations are usually performed with special contractors and overseen by special inspection by a Certified Asbestos contractor who is able to wear protective gear and both observe and test the asbestos abatement. In this case, the special asbestos inspection company was Patriot Environmental. While Patriot Environmental was responsible to oversee all aspects of asbestos abatement at all eleven (11) schools, it is unclear whether Patriot Environmental was overseeing the Mesa View Roof removal. The District has made inquiries with Patriot Environmental, however, Patriot Environmental has not responded as to whether they were performing special inspection or if Mr. Moberly was undertaking the special inspection.
There is a typical protocol where the inspector is required to notify the contractor that there is a safety deviation. Mr. Moberly noted issues with transite roof tile removal on July 17 and July 18, 2014, when there was no environmental inspection company on site. There is a Notice of Deviation to Chapman Coast roofing dated July 31, 2014. However, other than noting the failure to comply with specified safety requirements, there is no notification of improper asbestos removal to B&M Tear Off.
There was no special inspection provided on Mesa View and Mr. Moberly did not request special inspection be hired to oversee the Mesa View roof removal operation. Thus, despite having the opportunity to stop construction and the removal of asbestos, it appears that Mr. Moberly failed to do so. When there was an asbestos violation on Saturday, August 23, 2014, a day when SCAQMD was not in operation, rather than notify the contractor to stop the improper asbestos removal, Mr. Moberly appears to have allowed the entire roof removal without a notice of non-conformance or any attempt to stop the work.
The District did not ask for Mr. Moberly to be removed from the Mesa View and Hope View projects on September 27, 2014. The District learned that the inspection company had Mr. Moberly removed, but the exact reasons are unclear. The District did receive a threatening e-mail indicating that Mr. Moberly planned on notifying the press of asbestos oversight issues that appear to have occurred and were resolved over a month prior to Mr. Moberly being removed from the projects. It appears that Mr. Moberly notified Kacey Montoya of KTLA the evening after he was removed from the projects. The District is not aware of any attempts to notify the District that work should be stopped and there is no written record of any notifications to the District that there was an asbestos issue prior to the issue coming to light on the evening news on September 27, 2014.
The only time the District is aware that Mr. Moberly was going to notify the District of asbestos or construction problems was in Mr. Moberly’s September 27, 2014 e-mail correspondence that was written only to the construction manager, the architect, and Mr. Moberly’s employer. A copy of the e- mail was provided to the District on October 2, 2014. We are unaware of any notification from Mr. Moberly. In fact, when the evening news addressed asbestos violations, multiple District administrators tried to reach Mr. Moberly to ascertain more information about the concerns that were being complained of, but Mr. Moberly did not return telephone calls.

4. Please list all government agencies, environmental, contracting, criminal currently investigating one or more incidents or violations.

Cal/OSHA began an investigation during the first full week of October.

5. Are there any state/federal/local regulations concerning construction or abatement while children are present in school? If so, were there any violations?
There are no regulations prohibiting asbestos abatement while children are in school. Abatement is governed by AQMD Rule 1403. Cal/OSHA requirements are governed by California Code of Regulations, Title 8 Section 1529.

Silenced By the Ocean View School District

This morning, in the VOICE forum on Facebook, I answered  a comment regarding OVSD board president Gina Clayton Tarvin getting “smeared.” It is posted below, and as a result Facebook has banned me for SEVEN days. Read for yourself. Her behavior is well documented in terms of her baseless attacks. And abuses of power.

The irony of course is that by accusing them of what they do – trying to shut down voices – my voice was shut down. Is this what you elected? Is this where you want your tax dollars going? I encourage all of you to challenge Gina Clayton Tarvin as to her involvement in this. Let her hear your voice. Let her know what you think of this situation.

Happy New Year, HB – and a visit into that little building on PCH…

First of all, wishing you a very Happy and Healthy 2016, Huntington Beach. We’ve had over 45,000 unique visitors in the first few months of Surf City Chronicles, and are anxious to keep telling stories that matter to the community in the new year.

Now, you’ve no doubt passed this building many times on PCH at 17th, right? Have you ever wondered what it was?

As it turns out, the small, beige structure dates back to the late 1920s-early 1930s and is a state-operated office which was built to collect royalties from several state-owned oil concerns.

And today, it functions in the exact same capacity. Interestingly, inside the building in a bank-quality vault, where the cash would be kept way back when, before things like digital transfer technology.

 

It’s a non-nonsense look to the past of Huntington Beach; a safe that is today used for storage but at one time was where cash royalties would be held for pickup.

So next you pass by, now you’ll know just what that little building not only used to be used for, but how it still plays a part in our city’s history.

“Adrenalized” With Def Leppard’s Phil Collen in Huntington Beach
